Do you need planning permission for a garden wall in Scotland?

In Scotland some walls and fences fall under permitted development and need no application. It depends mainly on height, whether the wall fronts a road, and whether the property is listed or in a conservation area. The rules have exceptions, so confirm your own case with your local authority before building.

What is permitted development?

Permitted development is work you can carry out without a planning application. Scotland has its own rules, set out in national planning legislation and explained on mygov.scot.

What usually matters for a wall?

Councils look at the same handful of points.

  • The finished height of the wall, fence or gate.
  • Whether it fronts a road, footpath or public space.
  • Whether the property is listed or in a conservation area.
  • Whether the site sits in a designated area with tighter rules.
  • Whether an earlier permission removed permitted development rights.

Why can't I just use a height rule from a website?

Because exceptions apply, and they are property specific. A wall that is fine in one street may need consent in the next if that street is in a conservation area.

Who do I ask in Edinburgh?

The City of Edinburgh Council planning service. If you are in Midlothian, East Lothian or West Lothian, ask that council instead. A short enquiry before you build is far cheaper than a retrospective application.

Is a listed building different?

Yes. Listed building consent can be required for work to walls and boundaries within the curtilage, even where planning permission is not. Always check first.

Does a building warrant apply too?

Planning permission and building warrant are separate systems. Some structures need one, both or neither. Check both before starting.
